Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the Tuch mobile application and the web account-management surface at app.tuch.live (together, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What Tuch is — and is not

Tuch is a personal coaching and self-reflection tool.

Tuch is NOT:

  • A licensed therapist, psychologist, or psychiatrist
  • A medical provider or healthcare service
  • A crisis intervention service
  • A substitute for professional mental-health care

Nothing Tuch provides constitutes medical advice, psychological treatment, a therapeutic relationship, or a clinical diagnosis.

3. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement. If you are between 13 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. Account and identity

Your account is identified by your Agent ID — a random UUID v4 generated when you first open the app. Tuch does not collect a username or password from you, and personal information such as your name or email stays on your device.

You are responsible for keeping your Agent ID secure. Your Agent ID is your access key to the web account-management surface. Tuch is not responsible for unauthorized access that results from your Agent ID being shared, posted publicly, or otherwise disclosed by you.

5. Subscription and billing

  • Free trial. New users receive a 10-day free trial. No credit card is required to start.
  • Subscription price. $19.99 USD per month after the trial. Local currencies may apply where billing is handled by Apple.
  • iOS subscriptions. Managed through Apple. Apple's Media Services Terms and refund policy apply. Cancel anytime in Settings → Apple ID → Subscriptions on your iPhone.
  • Android and web subscriptions. Managed through Stripe. You may cancel anytime at app.tuch.live/account.
  • Cancellation. You may cancel your subscription at any time. Access continues until the end of the paid period. Canceling does not generate an automatic refund for the current period unless required by applicable law or the relevant app store's policy.
  • Refunds. iOS refund requests are handled by Apple. Android and web refunds are handled according to our refund policy; contact support@tuchapp.com.
  • Price changes. We will provide at least 30 days' advance notice of any price change before it takes effect.

6. Third-party model terms

The Service includes on-device use of Google's Gemma model. By using the Service, you agree to comply with the Gemma Prohibited Use Policy, available at https://ai.google.dev/gemma/prohibited_use_policy.

7. Acceptable use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to reverse-engineer, extract, or otherwise misuse the coaching models or any part of the Service
  • Attempt to access another user's account or Agent ID
  • Use the Service in any way that violates the Gemma Prohibited Use Policy or any applicable third-party model terms
  • Use the Service in any way that harasses, threatens, or abuses any person or attempts to elicit content that does so
  • Interfere with or disrupt the integrity or performance of the Service

8. Intellectual property

The Tuch app, its code, its design, and its branding are owned by Tuch Inc. All rights not expressly granted to you under these Terms are reserved.

Your content — journals, goals, reflections, and conversations — remains yours. Because that content stays on your device, we never access, store, or have rights to use it.

9. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. TUCH DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL TUCH, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF TUCH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TUCH'S TOTAL LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TUCH IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES; IF YOU RESIDE IN SUCH A JURISDICTION, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

10. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. Nothing in this section limits your statutory rights under the law of your country of residence.

11. Changes to these Terms

We will notify you of material changes to these Terms via the app and, where you have enabled email notifications, by email. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.

12. Termination

You may stop using the Service at any time. Deleting your account (in the app or at app.tuch.live/account) permanently removes your anonymized server-side data within 30 days, excluding records we are required to retain under applicable law. We may suspend or terminate your access to the Service if you materially violate these Terms.
